Compulsory Acquisition


 

Governments at all levels can compulsorily acquire land for a public purpose.

In Tasmania the basis for compensation is defined in the Land Acquisition Act 1993 (recently amended). Compensation is not limited to the value of the acquired land but also to any detrimental effect on the value of the remaining land after the acquisition.

In many cases compensation is also paid for business disturbance. We have had extensive experience in this area over a long period of time. We can provide advice and negotiate on the client’s behalf to ensure that fair compensation is paid in keeping with the Act.
