Public Open Space (POS)


 

Public open space is defined by the Local Government (Building and Miscellaneous Provisions) Act 1993 as 'space for public recreation or public gardens or for similar purposes'.

In the case of small subdivisions the physical land may not be be required for public use, instead the local council will request a monetary percentage of the value of the land to be contributed as part of the development conditions.
